Terms and Conditions of Entry for the “Why APP2024” Competition

  1. Information on how to enter and prize details form part of these conditions. Entry into this Competition is deemed acceptance of these terms and conditions of entry.
  2. The promoter is The Pharmacy Guild of Australia, Queensland Branch ABN 87 076 197 623 of 132 Leichhardt Street, Spring Hill QLD 4000 (Promoter).
  3. The Competition will be open from 9.00am AEST on Thursday 15 February 2024 and will continue until 11:59pm AEST on Thursday 29 February 2024 (Competition Period).

Eligible Entrants

  1. Entry is open to all Australian residents aged 18 years and over who are (Eligible Entrants):
    • Registered Pharmacists with a current AHPRA registration number, OR
    • Pharmacy Students who are currently enrolled and completing their studies with an Australian University, OR
    • Pharmacy Assistants, Retail Managers and Dispensary Technicians employed in a community or hospital pharmacy, or an associated health service, OR
    • Pharmacy Interns who currently hold a provision AHPRA registration.

Management, employees or contractors of the Promoter and other agencies, firms or companies associated with the Promoter (including suppliers of prizes), and their immediate families are not eligible to enter.

How to enter

  1. To enter this Competition (Entry), Participants must;
    • create a video that answers “Why do you want to attend APP2024?”
    • upload the video to the briefed social platform using “#WhyAPP2024”
  2. Any video submitted as part of an Entry must be at least 30 seconds long, and a maximum of 60 seconds long.
  3. Entries will only be accepted by the Promoter if Participants:
    • upload video to the briefed social platform using “#WhyAPP2024”
  4. Only one Entry is permitted per person, and all Entries must be received by the Promoter by no later than 11:59pm AEST on Thursday 29 February 2024.

Prize

  1. The Winner of the Competition will receive full registration to APP2024, including a Street Party ticket, valued at $1,105 (Prize).
  2. The Prize is not transferable or exchangeable and is not redeemable for cash. All other costs associated with the Prize are the responsibility of the Winner.
  3. If the Winner has already registered for APP2024 in any capacity, they will receive the Prize and a full refund for their existing registration.

Judging

  1. This Competition is a game of skill and will be judged by the Promoter. The Promoter will award the prize listed in clause 9 to the winning Entry (Winner).
  2. Each Entry will be individually judged based on creative merit and how well they answer “Why do you want to attend APP2024?”.
  3. The judges’ decision is final and no correspondence will be entered into.
  4. No responsibility is accepted for any Entry that is late, lost or misdirected, or if the Winner does not claim their Prize in accordance with these terms.

Claiming the Prize

  1. The Winner’s name and video entry will be published on the APP Conference website (www.appconference.com) on Friday 1 March 2024. The winner will also be contacted by phone or email by the Promoter, and must provide written confirmation of their intention to claim the prize within two (2) business days of being notified.

If the Winner does not claim the Prize by Tuesday 5 March 2024, or cannot provide suitable proof as to eligibility or compliance with these Terms, they will forfeit the Prize in its entirety and the Promoter will choose an alternate winner from the rest of the Entries at their sole discretion.

General

  1. The Promoter accepts no responsibility for any variation in the value of the Prize and will not be held liable for any loss, damage or injury which results directly or indirectly from this Competition.
  2. If the Promoter is unable to provide the winner with the Prize, the Promoter reserves the right to provide to the relevant winner an alternative prize of similar monetary value to the relevant Prize, subject to any written directions given by State or Territory legislation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
  3. The Promoter accepts no responsibility for any entries not received for any reason during the Competition Entries will be deemed to be accepted at the time of receipt by the Promoter (and not at the time the entry is sent to the Promoter).  The Promoter accepts no responsibility for lost, late or misdirected entries. The Promoter is also not responsible for technical difficulties with the mechanism that facilitates entry into the Competition and does not warrant that that mechanism will be available at all times.
  4. If, for any reason, the Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness or integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to take any action that may be available to it, subject to State and Territory regulations.
  5. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, does not properly comply with the entry process or who acts in a manner inconsistent with the spirit of the Competition, will be ineligible to win.
  6. Incomplete, illegible or incorrect entries, or entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win.
  7. The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms and conditions of entry. In the event there is a dispute concerning the conduct of the Competition, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.
  8. All Eligible Entrants:
    • consent to the Promoter using and disclosing their personal information for any purpose in connection with the Competition;
    • consent to the use of his/her/their name and image in any material, including promotional material (Material) in connection with the Competition and without any compensation to the Eligible Entrant;
    • consent to their personal information being added to Australian Pharmacy Guild event, program, and award databases, including but not limited to the Australian Pharmacy Professional Conference and Trade Exhibition (APP), Pharmacy Connect and the Pharmacy Assistant National Conference;
    • agree that all rights, title and interest (including intellectual property rights) in the Material will automatically vest in the Promoter on its creation;
    • unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials and agree to not institute, maintain or support any claim or proceeding for infringement of any such rights; and
    • understand that the Promoter’s privacy policy (see https://www.guild.org.au/privacy-policy) contains further information about how the Promoter uses, discloses and stores personal information. It also contains details about how you can access and seek correction of your personal information.
  9. To the extent permitted by law, the Promoter is not liable for any loss or damage whatsoever (including, but not limited to, direct or consequential loss) or personal injury suffered or sustained in connection with this Competition.
  10. The Promoter accepts no responsibility for any tax liabilities that may arise from winning the Prize.
  11. The Promoter’s decisions in respect of all matters to do with the Competition are final.
  12. These terms and conditions contain the entire agreement between you and the Promoter about its subject matter. Any previous understanding, agreement, representation, representation or warranty relating to that subject matter is replaced by this document and has no further effect.

Social Media

  1. Social media membership pages, applications and use of social media generally is subject to the prevailing terms and conditions of use of the social media platform. Unless otherwise indicated in these Terms and Conditions, the Competition is in no way sponsored, endorsed or administered by, or associated with, any social media platform including, but not limited to, Instagram, Facebook, Twitter and LinkedIn. If an Entrant uses social media to participate in the Competition, the Eligible Entrant understands that they are providing their information to the Promoter and not to any social media platform. Eligible Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other Internet users. By participating in the Competition, Eligible Entrants release Instagram, Facebook, Twitter, LinkedIn, or applicable social media sites from all claims, liabilities, suits, actions and expenses, including costs of litigation and reasonable legal costs associate with the Competition.

Privacy Collection Statement

  1. By submitting an Entry into this competition Entrants consent to receive promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time) and its related entities. Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter.
  2. The Promoter and its related entities collect entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). The Promoter may disclose personal information collected to an agent who is engaged to conduct the competition judging and for prize fulfilment. The Promoter may also disclose personal information collected to Australian regulatory authorities, such as the regulators of trade promotions. The Promoter will otherwise handle your personal information in accordance with its Privacy Policy available at see https://www.guild.org.au/privacy-policy

Intellectual property rights

  1. All intellectual property rights in the Entries vest in the Promoter upon submission of the relevant Entry. Where the Competition involves submission of any materials including but not limited to answers to questions, a statement, idea or opinion, video or voice recordings, images, works of art, designs or photographs (Content), all Entrants represent, warrant and agree that:
    • the Content must not contain any viruses or cause or be likely to cause any injury or harm to any person or entity;
    • the Content must be the work of the individual submitting it;
    • the Content must not have been published elsewhere or have won a prize in any other competition or promotion;
    • before submitting the Content, Entrants have obtained all appropriate consents and/or permission relating to a person who appears in, or whose property appears in, the Content.
    • each Entrant must warrant that the submission of the Content does not infringe the intellectual property rights of any third party.
    • Entrants must warrant that the Content they are submitting is their own work and that they own the copyright for it;
    • the Promoter may remove or decline to publish any Content without notice to the relevant Eligible Entrant.
    • the Promoter may use their likeness, image and/or voice in the event that the Entrant is the Winner (including photograph, film or recording) in any media whatsoever throughout the world, in perpetuity, for the purpose of promoting this Competition or other similar competitions and promotions, and promoting any similar events or services done by the Promoter.
    • The Entrant will not be entitled to any remuneration for such use.
